ถ้าลูกหนี้จำต้องชำระหนี้ต่อเมื่อเจ้าหนี้จะต้องชำระหนี้ตอบแทน ด้วยไซร้ ท่านว่าลูกหนี้จะกำหนดว่ ต่อเมื่อเจ้าหนี้ชำระหนี้ตอบแทนจึงให้มีสิทธิับเอาทรัพย์ที่วาง ไว้นั้นก็ได้
