ในเบื้องต้นให้พยานตอบคำถามเรื่อง นาม อายุ ตำแหน่ง หรืออาชีพภูมิลำเนาและ ความเกี่ยวพันกับคู่ความ แล้วศาลอาจปฏิบัติอย่างใดอย่างหนึ่งต่อไปนี้ (๑)ศาลเป็นผู้ถามพยานเองกล่าวคือแจ้งให้พยานทราบประเด็นและข้อเท็จจริงซึ่งต้องการสืบแล้ว ให้พยานเบิกความในข้อนั้นๆโดยวิธีเล่าเรื่องตามลำพังหรือโดยวิธีตอบคำถามของศาลหรือ
(๒) ให้คู่ความซักถาม และถามค้านพยานไปทีเดียวดังที่บัญญัติไว้ในมาตราต่อไปนี้
