ถ้าคู่ความฝ่ายใดยื่นคำขอโดยทำเป็นคำร้องให้ศาลสั่งกำหนดวิธีการอย่างใด ๆ ที่ บัญญัติไว้ในภาค ๔ เพื่อคุ้มครองสิทธิของคู่ความในระหว่างการพิจารณา หรือเพื่อบังคับตามคำพิพากษาหรือคำสั่ง ให้ศาลมีคำสั่งอนุญาตหรือยกคำขอนั้นเสียโดยไม่ชักช้า ถ้าในเวลาที่ยื่นคำขอนั้นศาลจะชี้ขาดคดีได้อยู่แล้ว ศาลจะวินิจฉัยคำขอนั้นในคำพิพากษา หรือใน คำสั่งชี้ขาดคดีก็ได้
