ในกรณีวิธีารเพื่อความปลอดภัยตามมาตรา ๔๖แห่งประมวลกฎหมาย อาญาให้นำบทบัญญัติแห่งประมวลกฎหมายวิธีพิจารณาความอาญามาใช้บังคับเสมือนเป็นความผิด อาญาแต่ห้ามมิให้คุมขัชั้นสอบสวนเกิ กว่ สี่สิบแปดชั่วโมงนับแต่เวลาที่ผู้ถูกจับมาถึงที่ทำการของ พนักงานฝ่ายปกครองหรือตำรวจ แต่มิให้นับเวลาเดินทางตามปกติที่นำตัวผู้ถูกจับมาศาลรวมเข้าใน กำหนดเวลาสี่สิบแปดชั่วโมงนั้นด้วย
