ถ้าผู้ต้องโทษกักขังถูกกักขังในที่อาศัยของผู้นั้นเอง หรือของผู้อื่นที่ ยินยอมรับผู้นั้นไว้ ผู้ต้องโทษกักขังนั้นมีสิทธิที่จะดำเนินการในวิชาชีพหรืออาชีพของตนในสถานที่ ดังกล่าวได้ ในการนี้ ศาลจะกำหนดเงื่อนไขให้ผู้ต้องโทษกัขัปฏิบัติอย่างหนึ่งอย่างใดหรือไม่ก็ได้ แล้วแต่ศาลจะเห็นสมควร
