ผู้ใดกระทำชำเราศพ ต้องระวางโทษจำคุกไม่เกิ สามปีหรือ ปรับไม่เกินหกหมื่นบาทหรือทั้งจำทั้งปรับ การกระทำชำเราตามวรรคหนึ่ง หมายความว่าการกระทำเพื่อสนองความใคร่ของ ผู้กระทำโดยการใช้อวัยวะเพศของผู้กระทำกระทำกับอวัยวะเพศ ทวารหนัก หรือช่องปากของศพ หรือการใช้สิ่งอื่นใดกระทำกับอวัยวะเพศหรือทวารหนักของศพ
