ถ้าผู้ต้องเสียภาษีอากรไม่ปฏิบัติตามหมายหรือคำสั่งของเจ้าพนักงาน ประเมินตามมาตรา ๑๙หรือไม่ยอมตอบคำถามเมื่อซักถาม โดยไม่มีเหตุผลอันสมควร เจ้าพนักงาน ประเมินมีอำนาจประเมินเงินภาษีอากรตามที่รู้เห็นว่าถูกต้องและแจ้งจำนวนเงินซึ่งต้องชำระไปยังผู้ ต้องเสียภาษีอากร ในกรณีนี้ห้ามมิให้อุทธรณ์การประเมิน
