ในกรณีที่ผู้กระทำความผิดซึ่งต้องรับโทษตามหมวดนี้เป็นนิติ บุคคล กรรมการผู้จัด ผู้จัดการ หรือผู้แทนของนิติบุคคลนั้น ต้องรับโทษตามที่บัญญัติไว้สำหรับ ความผิดนั้น ๆด้วย เว้นแต่จะพิสูจน์ได้ว่าตนมิได้ยินยอมหรือมีส่วนในการกระทำความผิดของนิติ บุคคลนั้น
