การสรรหาและการเลือกผู้ตรวจการแผ่นดินให้นำบทบัญญัติมาตรา ๒๐๖ และมาตรา ๒๐๗มาใช้บังคับโดยอนุโลม โดยให้มีคณะกรรมการสรรหาจำนวนเจ็ดคนประกอบด้วย ประธานศาลฎีกา ประธานศาลรัฐธรรมนูญ ประธานศาลปกครองสูงสุด ประธานสภาผู้แทนราษฎร ผู้นำฝ่ายค้านในสภาผู้แทนราษฎร บุคคลซึ่งที่ประชุมใหญ่ศาลฎีกาคัดเลือกจำนวนหนึ่งคน และ บุคคลซึ่งที่ประชุมใหญ่ตุลาการในศาลปกครองสูงสุดคัดเลือกจำนวนหนึ่งคน และให้นำบทบัญญัติ มาตรา ๒๓๑(๑) วรรคสอง มาใช้บังคับด้วยโดยอนุโลม
