ให้กรรมการตุลาการศาลยุติธรรมผู้ทรงคุณวุฒิซึ่งดำรงตำแหน่งอยู่ในวัน ประกาศใช้รัฐธรรมนูญนี้ คงดำรงตำแหน่งเป็นกรรมการตุลาการศาลยุติธรรมต่อไป เว้นแต่ กรรมการผู้ทรงคุณวุฒิที่อายุครบหกสิบปีบริบูรณ์ในปีงบประมาณ ๒๕๕๐ และกรรมการผู้ทรงคุณวุฒิ ในชั้นศาลใดที่ย้ายไปจากชั้นศาลนั้น ทั้งนี้ ไม่เกินหนึ่งร้อยแปดสิบวันนับแต่วันประกาศใช้รัฐธรรมนูญนี้
