การเกณฑ์แรงงานจะกระทำมิได้ เว้นแต่โดยอาศัยอำนาจตามบทบัญญัติ แห่งกฎหมาย เฉพาะเพื่อประโยชน์ในการป้องปัดภัยพิบัติสาธารณะอันมีมาเป็นการฉุกเฉิน หรือโดย อาศัยอำนาจตามบทบัญญัติแห่งกฎหมายซึ่งให้กระทำได้ในระหว่างเวลาที่ประเทศอยู่ในภาวะสงคราม หรือการรบ หรือในระหว่างเวลาที่มีประกาศสถานการณ์ฉุกเฉินหรือประกาศใช้กฎอัยการศึก
