อำนาจอธิปไตยเป็นของปวงชนชาวไทย พระมหากษัตริย์ผู้ทรงเป็นประมุข ทรงใช้อำนาจนั้นทางรัฐสภา คณะรัฐมนตรี และศาล ตามบทบัญญัติแห่งรัฐธรรมนูญ เล่ม ๑๓๔ ตอนที่ ๔๐ ก รัฐสภา คณะรัฐมนตรี ศาล องค์กรอิสระ และหน่วยงานของรัฐ ต้องปฏิบัติหน้าที่ให้เป็นไป ตามรัฐธรรมนูญ กฎหมาย และหลักนิติธรรม เพื่อประโยชน์ส่วนรวมของประเทศชาติและความผาสุกของ ประชาชนโดยรวม
