การเกณฑ์แรงงานจะกระทำมิได้ เว้นแต่โดยอาศัยอำนาจตามบทบัญญัติ แห่งกฎหมายที่ตราขึ้นเพื่อป้องกันภัยพิบัติสาธารณะ หรือในขณะที่มีการประกาศสถานการณ์ฉุกเฉิน หรือประกาศใช้กฎอัยการศึก หรือในระหว่างเวลาที่ประเทศอยู่ในภาวะสงครามหรือการรบ
