การเสนอชื่อบุคคลตามมาตรา ๘๘ ต้องเป็นไปตามหลักเกณฑ์ ดังต่อไปนี้ เล่ม ๑๓๔ ตอนที่ ๔๐ ก
(๑) ต้องมีหนังสือยินยอมของบุคคลซึ่งได้รับการเสนอชื่อ โดยมีรายละเอียดตามที่คณะกรรมการ การเลือกตั้งกำหนด
(๒) ผู้ได้รับการเสนอชื่อต้องเป็นผู้มีคุณสมบัติและไม่มีลักษณะต้องห้ามที่จะเป็นรัฐมนตรี ตามมาตรา ๑๖๐ และไม่เคยทำหนังสือยินยอมตาม
(๑) ให้พรรคการเมืองอื่นในการเลือกตั้งคราวนั้น การเสนอชื่อบุคคลใดที่มิได้เป็นไปตามวรรคหนึ่ง ให้ถือว่าไม่มีการเสนอชื่อบุคคลนั้น
