ห้ามผู้ใดมีไว้ในครอบครองซึ่งยาเสพติดให้โทษในประเภท ๑ ประเภท ๒ หรือ ประเภท ๕ หรือวัตถุออกฤทธิ์ในประเภท ๑ หรือประเภท ๒ เพื่อเสพ การมีไว้ในครอบครองซึ่งยาเสพติดให้โทษในประเภท ๑ ประเภท ๒ หรือประเภท ๕ หรือ วัตถุออกฤทธิ์ในประเภท ๑ หรือประเภท ๒ ในปริมาณเล็กน้อยซึ่งไม่เกินปริมาณที่รัฐมนตรีว่าการ กระทรวงสาธารณสุขกำหนดในกฎกระทรวง ให้สันนิษฐานไว้ก่อนว่ามีไว้ในครอบครองเพื่อเสพ
