ในกรณีที่ผู้ขอคืนทรัพย์สินตามมาตรา ๗๙ วรรคหนึ่ง ไม่ทราบว่าพนักงาน อัยการได้มีคำร้องขอให้ศาลริบทรัพย์สิน จนศาลได้มีคำสั่งให้ริบทรัพย์สินนั้นแล้ว ผู้ขอคืนทรัพย์สิน ดังกล่าวอาจยื่นคำร้องขอคืนทรัพย์สินต่อศาลได้ภายในเวลาหนึ่งปีนับแต่วันที่ศาลมีคำสั่งให้ริบทรัพย์สิน
