เมื่อศาลประทับรับฟ้องแล้ว ห้ามมิให้ศาลอนุญาตให้ถอนฟ้อง เว้นแต่จะได้ความว่า หากไม่อนุญาตให้ถอนฟ้องจะกระทบกระเทือนต่อความยุติธรรม
