ในการปฏิบัติหน้าที่ของเจ้าหน้าที่ป่าชุมชนตามมาตรา ๔๐ หากพบว่า มีผู้กระทำการฝ่าฝืนหรือไม่ปฏิบัติตามพระราชกฤษฎีกานี้ ระเบียบของคณะกรรมการนโยบาย หรือข้อบังคับของคณะกรรมการจัดการป่าชุมชน และไม่อาจเรียกประชุมคณะกรรมการจัดการป่าชุมชน ได้ทัน ให้มีอำนาจสั่งให้ผู้นั้นกระทำการหรืองดเว้นการกระทำใด ๆ ในป่าชุมชนได้ หากผู้นั้นไม่ปฏิบัติ ตามคำสั่ง ให้มีอำนาจสั่งให้ผู้นั้นออกจากป่าชุมชน และให้รายงานคณะกรรมการจัดการป่าชุมชน และคณะกรรมการป่าชุมชนประจำจังหวัดทราบโดยมิชักช้า
