ในกฎกระทรวงนี้ “เด็กกำพร้า” หมายความว่า เด็กซึ่งเกิดในราชอาณาจักรไทยโดยไม่ได้สัญชาติไทย และบิดาและมารดาของเด็กนั้นเสียชีวิต หรือไม่ปรากฏบิดาและมารดาหรือไม่สามารถสืบหาบิดา และมารดาของเด็กนั้นได้ ทั้งนี้ ไม่ว่าจะอยู่ในความอุปการะของบุคคลหรือสถานสงเคราะห์ที่ได้รับอนุญาตให้ จัดตั้งขึ้นตามกฎหมายว่าด้วยการคุ้มครองเด็ก หรือเป็นเด็กเร่ร่อน
