ในกรณีที่มีกำรก้ำหนดค่ำทดแทนให้แก่ผู้มีสิทธิได้รับค่ำทดแทนจำกกำรน้ำน้ำไปเฉลี่ย ให้แก่หน่วยงำนของรัฐตำมประกาศที่ออกตามมาตรา ๖๐ วรรคหนึ่ง ให้หน่วยงำนของรัฐนันมีหน้ำที่ ในกำรจ่ำยค่ำทดแทนให้แก่ผู้มีสิทธิได้รับค่ำทดแทน เว้นแต่เป็นหน่วยงำนของรัฐที่ด้ำเนินกำรโดยไม่เก็บ ค่ำน้ำหรือไม่แสวงก้ำไร
