ผู้รับใบอนุญาตต้องเก็บรักษาเชื้อเพลิงนิวเคลียร์ใช้แล้วตามวิธีการที่ระบุไว้ในรายงาน วิเคราะห์ความปลอดภัยของสถานประกอบการทางนิวเคลียร์ฉบับสมบูรณ์ซึ่งเป็นเงื่อนไขในใบอนุญาต ดำเนินการสถานประกอบการทางนิวเคลียร์ เว้นแต่มีการส่งเชื้อเพลิงนิวเคลียร์ใช้แล้วไปดำเนินการ ตามข้อ ๑๑ การเก็บรักษาเชื้อเพลิงนิวเคลียร์ใช้แล้วตามวรรคหนึ่งสามารถดำเนินการได้สองวิธี ดังต่อไปนี้
(๑) การเก็บแบบเปียก โดยใช้น้าในการระบายความร้อน
(๒) การเก็บแบบแห้ง โดยใช้อากาศในการระบายความร้อน
