ในกรณีที่สมาชิกสภาท้องถิ่นหรือผู้บริหารท้องถิ่นผู้ใดปฏิบัติหน้าที่ต่อไปไม่ได้ มิให้นับ บุคคลดังกล่าวเข้าในจำนวนรวมของสมาชิกเท่าที่มีอยู่ของสภาท้องถิ่นหรือคณะผู้บริหารท้องถิ่น
