ผู้ซึ่งจะได้รับพระราชทานอภัยโทษตามพระราชกฤษฎีกานี้ ต้องมีตัวอยู่ใน ความควบคุมของทางราชการ หรือถูกกักขังไว้ในสถานที่หรือที่อาศัยที่ศาลหรือทางราชการกำหนด ในวันที่พระราชกฤษฎีกานี้ใช้บังคับติดต่อกันไปจนถึงวันที่ศาลออกหมายสั่งปล่อยหรือลดโทษหรือ นายกรัฐมนตรีมีคำสั่งปล่อยหรือลดโทษตามที่บัญญัติไว้ในพระราชกฤษฎีกานี้ เว้นแต่ผู้ทำงาน บริการสังคมหรือทำงานสาธารณประโยชน์แทนค่าปรับ และผู้ได้รับการปล่อยตัวคุมประพฤติ
