ให้ยกเลิกความในวรรคสามของมาตรา ๑๔๒ แห่งประมวลกฎหมายวิธีพิจารณา ความอาญา และให้ใช้ความต่อไปนี้แทน “ในกรณีที่เสนอความเห็นควรสั่งฟ้อง ให้พนักงานสอบสวนส่งสำนวนพร้อมกับผู้ต้องหาไปยัง พนักงานอัยการ เว้นแต่ผู้ต้องหานั้นถูกขังอยู่แล้ว หรือผู้ต้องหาซึ่งถูกแจ้งข้อหาได้หลบหนีไป”
