ในกรณีที่ผู้รับบำนาญหรือข้าราชการส่วนท้องถิ่นซึ่งออกจากราชการมีกรณีหรือ ต้องหาว่ากระทำความผิดวินัยหรืออาญาก่อนออกจากราชการ จะขอรับบำเหน็จดำรงชีพได้เมื่อกรณี หรือคดีถึงที่สุดและมีสิทธิรับบำนาญ โดยขอรับตามระยะเวลาที่กำหนดไว้ในข้อ ๒
