ผู้ใดประกอบกิจการขนส่งทางรางโดยไม่ได้รับใบอนุญาตตามมาตรา ๓๒ ต้องระวางโทษจำคุกไม่เกินสิบปี หรือปรับไม่เกินสองล้านบาท หรือทั้งจำทั้งปรับ
