ในกฎกระทรวงนี้ “ภาระที่ถูกรอนสิทธิ” หมายความว่า ภาระจำยอม สิทธิอาศัย สิทธิเหนือพื้นดิน สิทธิเก็บกิน ภาระติดพันในอสังหาริมทรัพย์ รวมถึงสัญญาเช่าอสังหาริมทรัพย์ที่มีการชำระค่าตอบแทนเป็นการล่วงหน้า ตลอดระยะเวลาของการเช่า ที่ตกติดมากับอสังหาริมทรัพย์อันเป็นมรดกที่ต้องเสียภาษีการรับมรดก “ค่าตอบแทน” หมายความว่า เงินที่ได้รับล่วงหน้าหรือเงินอื่นที่มีลักษณะทำนองเดียวกัน เพื่อเป็นการตอบแทนจากภาระที่ถูกรอนสิทธิตลอดระยะเวลาของภาระดังกล่าว
