ให้ผู้มีหน้าที่เสียภาษีที่จะของดเบี้ยปรับยื่นคำร้องเป็นหนังสือ พร้อมด้วยสำเนาเอกสาร หรือหลักฐานที่ออกโดยศาลหรือหน่วยงานที่มีคำสั่งให้ยึดหรืออายัดที่ดินหรือสิ่งปลูกสร้างนั้น ต่อผู้บริหาร ท้องถิ่นภายในวันที่ ๓๑ มกราคม ของปีภาษีนั้น เมื่อผู้บริหารท้องถิ่นได้รับคำร้องตามวรรคหนึ่งแล้ว หากเห็นว่าเป็นเอกสารหรือหลักฐานที่ถูกต้อง ให้มีคำสั่งงดเบี้ยปรับ
