บรรดาคดีของท้องที่จังหวัดภูเก็ต ซึ่งค้างพิจารณาอยู่ในศาลจังหวัดภูเก็ต ในวันเปิดทำการศาลแขวงภูเก็ตตามมาตรา ๔ ให้คงพิจารณาพิพากษาต่อไปในศาลจังหวัดภูเก็ต บรรดาคดีของท้องที่ตามที่กำหนดไว้ในวรรคหนึ่ง ซึ่งอยู่ระหว่างที่ศาลจังหวัดภูเก็ตมีคำสั่งให้ผัดฟ้อง หรือให้ขังผู้ต้องหาไว้ระหว่างสอบสวน แล้วแต่กรณี ในวันเปิดทำการศาลแขวงภูเก็ต ให้ศาลจังหวัดภูเก็ต มีอำนาจพิจารณาเกี่ยวกับการผัดฟ้องหรือขังระหว่างสอบสวนนั้นต่อไป
