ให้ศาลพิจารณาค้าร้องของพนักงานอัยการโดยเร็ว ถ้าเป็นที่พอใจว่ากรณีมีเหตุ ตามที่บัญญัติในมาตรา ๓๗ ให้ศาลมีค้าสั่งคุมขังฉุกเฉินผู้ถูกเฝ้าระวังได้ ผู้ถูกเฝ้าระวังอาจยื่นค้าร้องขอฝ่ายเดียวเพื่อให้ศาลยกเลิกค้าสั่งนันเสีย ถ้าศาลมีค้าสั่งยกเลิก ค้าสั่งคุมขังฉุกเฉิน ค้าสั่งเช่นว่านีให้เป็นที่สุด หลักเกณฑ์ วิธีการ และเงื่อนไขในการมีค้าสั่งของศาลตามมาตรานี ให้เป็นไปตามที่ก้าหนด ในข้อบังคับของประธานศาลฎีกาโดยความเห็นชอบของที่ประชุมใหญ่ศาลฎีกา
