ในการให้บริการเกี่ยวกับเทคโนโลยีช่วยการเจริญพันธุ์ทางการแพทย์ ผู้ให้บริการ เกี่ยวกับเทคโนโลยีช่วยการเจริญพันธุ์ทางการแพทย์ อาจทำการตรวจวินิจฉัยโรคทางพันธุกรรมในตัวอ่อน ที่อาจเกิดขึ้นได้ตามความจำเป็นและสมควร ทั้งนี้ ต้องไม่เป็นการกระทำในลักษณะที่อาจทำให้เข้าใจได้ว่า เป็นการเลือกเพศ การตรวจวินิจฉัยตามวรรคหนึ่ง ให้เป็นไปตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่แพทยสภา ประกาศกำหนดโดยความเห็นชอบของคณะกรรมการ
