เมื่อมีประกาศตามมาตรา ๑๖ แล้ว ในกรณีที่ผู้ประกอบกิจการในอุตสาหกรรม เป้าหมายรายใดประสงค์จะได้รับสิทธิและประโยชน์ตามพระราชบัญญัตินี้ ให้มายื่นข้อเสนอโครงการลงทุน ต่อสำนักงาน เมื่อสำนักงานได้รับข้อเสนอโครงการลงทุนแล้ว ให้ดำเนินการวิเคราะห์และเสนอความเห็น ต่อคณะอนุกรรมการสรรหาและเจรจาเพื่อให้ความเห็นชอบในการเริ่มดำเนินการเจรจา และให้นำ บทบัญญัติมาตรา ๑๗ วรรคสองและวรรคสาม มาใช้บังคับ
