ผู้ขนส่งไม่ต้องรับผิดในการที่ของสูญหาย เสียหายหรือส่งมอบชักช้า หากพิสูจน์ ได้ว่าการสูญหาย เสียหาย หรือส่งมอบชักช้านั้นเกิดขึ้นหรือเป็นผลจากเหตุดังต่อไปนี้
(๑) เหตุสุดวิสัย
(๒) สภาพแห่งของนั้นเอง
(๓) การกระทำโดยจงใจหรือประมาทเลินเล่อของผู้ส่งหรือผู้รับตราส่ง หรือ
(๔) การปฏิบัติตามคำสั่งของผู้ส่งหรือผู้รับตราส่ง แล้วแต่กรณี เว้นแต่เป็นผลจากการกระทำ หรือละเว้นการปฏิบัติหน้าที่โดยมิชอบ หรือความประมาทเลินเล่อของผู้ขนส่ง หรือบุคคลที่ผู้ขนส่ง ต้องร่วมรับผิดตามมาตรา ๓๐
