ความในพระราชบัญญัตินี้ให้ใช้บังคับแก่การใช้สิทธิเรียกร้องค่าสินไหมทดแทน ที่เกิดจากสัญญารับขนคนโดยสารทางถนนระหว่างประเทศ ไม่ว่าการใช้สิทธิเรียกร้องนั้นจะมีมูลกรณี จากสัญญาหรือละเมิด ในกรณีที่มีการใช้สิทธิเรียกร้องค่าสินไหมทดแทนตามพระราชบัญญัตินี้ต่อลูกจ้าง ตัวแทน หรือผู้รับจ้างช่วงของผู้ขนส่ง บุคคลที่ถูกใช้สิทธิเรียกร้องดังกล่าวมีสิทธิยกข้อต่อสู้ของผู้ขนส่งตามที่กำหนด ในพระราชบัญญัตินี้ขึ้นต่อสู้ผู้ใช้สิทธิเรียกร้องได้ด้วย
