Section ๓๖

ผู้รับคำสั่งตามมาตรา ๑๓ มาตรา ๑๕ มาตรา ๑๗ มาตรา ๒๓ มาตรา ๓๑ หรือมาตรา ๓๒ ผู้ใดไม่เห็นด้วยกับคำสั่ง มีสิทธิอุทธรณ์ต่อบุคคล ดังต่อไปนี้

(๑) ในกรณีที่ ธปท. เป็นผู้ออกคำสั่ง ให้อุทธรณ์ต่อรัฐมนตรี

(๒) ในกรณีที่รัฐมนตรีเป็นผู้ออกคำสั่ง ให้เป็นไปตามกฎหมายว่าด้วยวิธีปฏิบัติราชการ ทางปกครอง ให้นำกฎหมายว่าด้วยวิธีปฏิบัติราชการทางปกครองมาใช้บังคับกับการพิจารณาวินิจฉัยอุทธรณ์ ตามพระราชบัญญัตินี้โดยอนุโลม
