ในกรณีที่ผู้ถูกลงโทษปรับทางปกครองไม่ยอมชำระค่าปรับทางปกครอง ให้นำ บทบัญญัติเกี่ยวกับการบังคับทางปกครองตามกฎหมายว่าด้วยวิธีปฏิบัติราชการทางปกครองมาใช้บังคับ และในกรณีที่ไม่มีเจ้าหน้าที่ดำเนินการบังคับตามคำสั่ง หรือมีแต่ไม่สามารถดำเนินการบังคับทางปกครองได้ ให้ ธปท. มีอำนาจฟ้องคดีต่อศาลปกครองเพื่อบังคับชำระค่าปรับ ในการนี้ ถ้าศาลปกครองเห็นว่าคำสั่ง ให้ชำระค่าปรับนั้นชอบด้วยกฎหมาย ให้ศาลปกครองมีอำนาจพิจารณาพิพากษาและบังคับให้มี การยึดหรืออายัดทรัพย์สินขายทอดตลาดเพื่อชำระค่าปรับได้
