ในกรณีที่ผู้นำของเข้าเพื่อการผ่านแดนหรือการถ่ายลำไม่นำของออกไปนอก ราชอาณาจักรภายในระยะเวลาตามมาตรา ๑๐๒ วรรคสอง หรือขอเปลี่ยนการผ่านพิธีการศุลกากรเป็น การนำเข้าและได้ปฏิบัติตามพระราชบัญญัตินี้แล้ว แต่ไม่เสียอากรหรือไม่ปฏิบัติตามกฎหมายอื่นที่เกี่ยวข้อง กับการศุลกากรภายในระยะเวลาดังกล่าว ให้ของนั้นตกเป็นของแผ่นดิน เล่ม ๑๓๔ ตอนที่ ๕๓ ก
