บุคคลใดประสงค์จะเป็นผู้รับมอบอำนาจจากผู้นำของเข้า ผู้ส่งของออก หรือ ผู้นำของผ่านแดนหรือผู้ขอถ่ายลำ ให้เป็นตัวแทนเพื่อดำเนินการอย่างใด ๆ เกี่ยวกับของที่นำเข้ามาใน หรือส่งออกไปนอกราชอาณาจักร ของเพื่อการผ่านแดน หรือของเพื่อการถ่ายลำ หรือกิจการอื่นใด ตามพระราชบัญญัตินี้ ต้องได้รับอนุญาตจากอธิบดีตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่อธิบดีประกาศ กำหนด ให้ถือว่าบุคคลที่ได้รับอนุญาตให้เป็นตัวแทนตามวรรคหนึ่ง เป็นเจ้าของของที่ได้นำเข้า ส่งออก ผ่านแดนหรือถ่ายลำด้วย
