เมื่อได้มีการลงนามในสัญญาร่วมลงทุนแล้ว ให้รัฐมนตรีกระทรวงเจ้าสังกัด แต่งตั้งคณะกรรมการกำกับดูแลขึ้นคณะหนึ่ง ประกอบด้วย ผู้แทนกระทรวงเจ้าสังกัดซึ่งเป็นข้าราชการ ในกระทรวงเจ้าสังกัดที่มิใช่หน่วยงานเจ้าของโครงการและมีตำแหน่งไม่ต่ำกว่าประเภทบริหารระดับต้น เลม่ ๑๓๖ ตอนที่ ๒๙ ก หนา้ ๒๐ เป็นประธานกรรมการ ผู้แทนสำนักงานอัยการสูงสุด และผู้แทนสำนักงาน เป็นกรรมการ และให้มีผู้แทน หน่วยงานเจ้าของโครงการหนึ่งคน เป็นกรรมการและเลขานุการ
