ให้กองทุนมีรายได้จากเงินที่ศาลสั่งบังคับกรณีผิดสัญญาประกันต่อศาล ตามประมวลกฎหมายวิธีพิจารณาความอาญา ค่าธรรมเนียมศาลตามประมวลกฎหมายวิธีพิจารณาความแพ่ง และค่าปรับตามคำพิพากษาในคดีอาญา ทั้งนี้ ในอัตราไม่เกินร้อยละห้าของจำนวนเงินเฉพาะส่วนที่นำส่งคลัง โดยความเห็นชอบของกระทรวงการคลัง
