นายจ้างผู้ใด ไม่แจ้งต่ออธิบดีหรือไม่จัดส่งคนต่างด้าวกลับไปยังประเทศต้นทาง ตามมาตรา ๒๘วรรคหนึ่ง ต้องระวางโทษปรับไม่เกินสองหมื่นบาท
