ในกรณีที่มีการฟ้องคดีเพื่อขอให้เพิกถอนสิทธิเลือกตั้งบุคคลใดบุคคลหนึ่ง และศาลมีคำพิพากษาให้เพิกถอนสิทธิเลือกตั้งของบุคคลนั้นแม้คำพิพากษายังไม่ถึงที่สุดก็ตาม เมื่อได้มี การประกาศบัญชีรายชื่อผู้มีสิทธิออกเสียงแล้ว ให้คณะกรรมการการออกเสียงประจำเขตออกเสียงถอนชื่อ ผู้ซึ่งถูกศาลสั่งเพิกถอนสิทธิเลือกตั้งโดยการขีดชื่อบุคคลนั้นออกจากบัญชีรายชื่อผู้มีสิทธิออกเสียง
