เมื่อสิ้นสุดระยะเวลาออกเสียงตามมาตรา ๓๔ หากผู้มาใช้สิทธิออกเสียงจำนวน ไม่น้อยกว่าห้าสิบคนในหน่วยออกเสียงใด เห็นว่าการออกเสียงในหน่วยออกเสียงนั้นเป็นไปโดยไม่สุจริต และเที่ยงธรรม ให้มีสิทธิยื่นคำร้องคัดค้านพร้อมทั้งแสดงหลักฐานต่อคณะกรรมการการเลือกตั้งหรือผู้ที่ คณะกรรมการการเลือกตั้งมอบหมาย ภายในยี่สิบสี่ชั่วโมงนับแต่การลงคะแนนออกเสียงสิ้นสุดลง
