ให้รัฐมนตรีพิจารณาวินิจฉัยอุทธรณ์ให้แล้วเสร็จภายในสามสิบวันนับแต่วันที่ ได้รับอุทธรณ์ ถ้ามีเหตุจำเป็นไม่อาจพิจารณาให้แล้วเสร็จได้ภายในระยะเวลาตามวรรคหนึ่ง ให้มีหนังสือ แจ้งให้ผู้อุทธรณ์ทราบก่อนครบกำหนดระยะเวลานั้น ในการนี้ ให้ขยายระยะเวลาพิจารณาอุทธรณ์ออกไปได้ ไม่เกินสองครั้ง ครั้งละไม่เกินสามสิบวันนับแต่วันที่ครบกำหนดระยะเวลาดังกล่าว ถ้ายังวินิจฉัยไม่แล้วเสร็จ ให้ถือว่ารัฐมนตรีเห็นด้วยกับผู้อุทธรณ์
