ผู้ใดกระทำกิจกรรมควบคุมซึ่งสินค้าที่เกี่ยวข้องกับการแพร่ขยายอาวุธที่มีอานุภาพ ทำลายล้างสูงโดยฝ่าฝืนหรือไม่ปฏิบัติตามพระราชบัญญัตินี้โดยรู้อยู่แล้วว่าผู้ใช้สุดท้ายจะนำไปดำเนินการ อย่างผิดกฎหมายจนเป็นเหตุให้ผู้อื่นได้รับอันตรายแก่ชีวิต หรือร่างกาย ผู้กระทำกิจกรรมควบคุม ต้องร่วมรับผิดชดใช้ค่าสินไหมทดแทนเพื่อการนั้น
