2 sectionsทรัพยากรน้าสาธารณะเป็นของส่วนรวม บุคคลมีสิทธิใช้หรือเก็บกักน้าได้ เท่าที่จ้าเป็นแก่ประโยชน์ในกิจกรรมหรือในที่ดินของตน โดยไม่เป็นเหตุให้เกิดความเดือดร้อนหรือ เสียหายแก่บุคคลอื่นซึ่งอาจใช้น้านัน ทังนี เว้นแต่พระราชบัญญัตินี หรือกฎกระทรวง ระเบียบ หรือ ประกาศที่ออกตามความในพระราชบัญญัตินี หรือกฎหมายอื่นบัญญัติไว้เป็นอย่างอื่น
เจ้าของหรือผู้ครอบครองที่ดินซึ่งมีน้าพุเกิดขึนหรือมีน้าไหลผ่านตามธรรมชาติ ไม่ว่าบนดินหรือใต้ดิน ย่อมมีสิทธิใช้หรือเก็บกักน้านันได้เท่าที่จ้าเป็นแก่ประโยชน์ในที่ดินของตน และ ไม่เป็นเหตุให้เกิดความเดือดร้อนหรือเสียหายแก่บุคคลอื่น
