เมื่อมีกรณีจำเป็นต้องเสนอให้มีการตรากฎหมาย ให้หน่วยงานของรัฐแสดงเหตุผล ความจำเป็นในการตรากฎหมายและต้องวิเคราะห์โดยมีข้อมูลและเอกสารหลักฐานประกอบชัดเจนว่า ไม่เป็นการสร้างภาระแก่ประชาชนเกินความจำเป็น คุ้มค่ากับภาระที่เกิดขึ้นแก่รัฐและประชาชน รวมทั้ง ไม่สามารถใช้มาตรการหรือวิธีการอื่นใดนอกจากการตราเป็นกฎหมาย
