ถ้าปรากฏว่าผู้ถูกกล่าวหาตกเป็นผู้วิกลจริตในระหว่างการแสวงหาข้อเท็จจริง ให้เจ้าหน้าที่ของรัฐระงับการแสวงหาข้อเท็จจริงไว้จนกว่าผู้นั้นจะหายวิกลจริต ในกรณีที่คดีขาดอายุความ ก่อนที่ผู้นั้นจะหายวิกลจริต ให้ยุติเรื่องและจำหน่ายคดีจากสารบบ
