ในกรณีที่คณะกรรมการ วลพ. วินิจฉัยว่า มีการเลือกปฏิบัติโดยไม่เป็นธรรม ระหว่างเพศโดยอาศัยบทบัญญัติแห่งกฎหมายที่ขัดหรือแย้งต่อรัฐธรรมนูญ และยังไม่มีคำวินิจฉัยของ ศาลรัฐธรรมนูญในส่วนที่เกี่ยวกับบทบัญญัตินั้น ให้คณะกรรมการ วลพ. ยื่นเรื่องต่อผู้ตรวจการแผ่นดิน เพื่อพิจารณายื่นเรื่องต่อศาลรัฐธรรมนูญเพื่อวินิจฉัยว่าบทบัญญัติแห่งกฎหมายดังกล่าวขัดหรือแย้ง ต่อรัฐธรรมนูญหรือไม่
