ให้คณะกรรมการอุทธรณ์ คณะกรรมการผังเมืองจังหวัด หรือคณะกรรมการ บริหารการผังเมืองส่วนท้องถิ่น มีคำวินิจฉัยอุทธรณ์ภายในหกสิบวันนับแต่วันได้รับอุทธรณ์ แล้วแจ้ง คำวินิจฉัยพร้อมด้วยเหตุผลเป็นหนังสือไปยังผู้อุทธรณ์และเจ้าพนักงานการผัง เจ้าพนักงานท้องถิ่น หรือ เจ้าหน้าที่ดำเนินการ แล้วแต่กรณี หลักเกณฑ์และวิธีการในการยื่นอุทธรณ์และวิธีพิจารณาในการวินิจฉัยคำอุทธรณ์ให้เป็นไป ตามที่กำหนดในกฎกระทรวง
